RAS Pre Exam-26.10.2013

MEDIUM

Consider the following and select the correct answer using the codes given below. (A) The Chief Minister communicates to the Governor the decisions of the administration of the affairs of the State. (B) The Chief Minister communicates to the Governor about legislative proposals. (C) The Chief Minister participates in the meetings of the National Development Council. (D) The Chief Minister submits for the consideration of the Council any matter on which a decision has been taken by a Minister but which has not been considered by the Council, if the Governor requires.

(1) (A) and (B)

(2) (A) and (D)

(3) (A), (B) and (C)

(4) (A), (B), (C) and (D)

Explanation

The duties of the Chief Minister include informing the Governor about the administration of the state, informing about legislative proposals, and placing a minister's decision before the Council of Ministers at the request of the Governor (Article 167). Also, the Chief Minister is a member of the National Development Council (NDC) and participates in its meetings. Thus, all statements are correct.

HARD

Consider the following statements regarding the responsibility structure of the State Cabinet:

The principle of collective responsibility ensures that if the Council of Ministers loses the confidence of the Legislative Assembly, the entire Council must resign.
Individual responsibility allows the Governor to dismiss a specific Minister even if the Council enjoys the majority.

Which of the statements given above are correct?

1 only

2 only

Both 1 and 2

Neither 1 nor 2

Explanation

🌟 Quick Verification

Direct Answer: Both 1 and 2 are correct.

🧠 Concept Blueprint

Collective Responsibility: Since they are collectively responsible to the Assembly, the whole cabinet is accountable as a unit. A 'no-confidence motion' against any one Minister is essentially a motion against the entire Council.
Individual Responsibility: Since Ministers serve during the 'pleasure of the Governor', the Governor has the discretionary power to dismiss an individual Minister for misconduct or loss of confidence, independent of the Council's status.

MEDIUM

Consider the following statements regarding the Chief Minister:

The Chief Minister is defined as the real executive head of the state government.
The oath of office for the Chief Minister includes an oath of secrecy.
The Governor administers the oath to the Chief Minister, but the President sets the format of the oath.

Which of the statements given above are correct?

1 and 2 only

2 and 3 only

1 and 3 only

1, 2, and 3

Explanation

🌟 Quick Verification

Direct Answer: 1 and 2 only are correct.
Core Concept: While the Governor administers the oath, the format is set by the Constitution (Third Schedule), not the President.

🧠 Concept Blueprint

Verification of Statements:
- Statement 1 is Correct: The CM is recognized as the real executive head of the state government.
- Statement 2 is Correct: The oath is officially titled the oath of office and secrecy.
- Statement 3 is Incorrect: The format is defined in the Third Schedule of the Constitution, not arbitrarily by the President.

EASY

Which of the following statements regarding the size and composition of the Council of Ministers is correct?

It includes only Cabinet Ministers.

It is limited to 10% of total Vidhan Sabha members.

It is limited to 15% of total Vidhan Sabha members.

It meets on a weekly basis.

Explanation

🌟 Quick Verification

Direct Answer: The correct answer is It is limited to 15% of total Vidhan Sabha members.

🧠 Concept Blueprint

Legislative Limitation:
- To curb the creation of 'jumbo' ministries, the constitution mandates a limit on the size of the Council of Ministers.
- The specific cap is 15% of the total strength of the Legislative Assembly (Vidhan Sabha).

📊 Fact Spotlight

Legislative Body	Limitation Parameter	Importance
Council of Ministers	Max 15% of House	Prevents bloated government
Cabinet	No fixed % limit	Based on importance of department

💡 Exam Strategy & Trivia

Tip

Common Pitfall: Do not confuse the 15% rule (which applies to the whole Council) with the Cabinet, which does not have a set percentage size but rather depends on department importance.

HARD

A minister expresses disagreement with a cabinet decision in a public forum. Which principle of the Council of Ministers has this minister violated?

Principle of Secrecy

Principle of Collective Responsibility

Principle of Individual Independence

Principle of Administrative Neutrality

Explanation

🌟 Quick Verification

Direct Answer: Principle of Collective Responsibility.
Core Concept: Binding nature of cabinet decisions.

🧠 Concept Blueprint

The Rule: Since the council acts as a single, unified team, once a decision is finalized, it becomes the collective stance. Publicly contradicting this decision undermines the principle that the government speaks with one voice.

📊 Fact Spotlight

Action	Violation
Leaking cabinet notes	Principle of Secrecy
Publicly opposing cabinet decision	Principle of Collective Responsibility
Failure to perform department duty	Individual Ministerial Responsibility

MEDIUM

MEDIUM

Assertion (A): The Chief Minister is appointed by the Governor.
Reason (R): The Governor exercises this power based on their own absolute discretion without any constitutional process.

Select the correct answer:

Both (A) and (R) are true, and (R) is the correct explanation of (A)

Both (A) and (R) are true, but (R) is not the correct explanation of (A)

(A) is true, but (R) is false

(A) is false, but (R) is true

Explanation

🌟 Quick Verification

Direct Answer: (A) is true, but (R) is false.

🧠 Concept Blueprint

Logical Breakdown:
- Assertion (A): This is a correct constitutional fact under Article 164(1).
- Reason (R): This is false. The Governor's power to appoint the Chief Minister is not 'absolute discretion'. It is governed by constitutional conventions and the parliamentary system (e.g., inviting the leader of the majority party/coalition). The Governor is not acting arbitrarily; they are following the democratic mandate established by the legislature.

💡 Exam Strategy & Trivia

Tip

Deep Insight: While the Governor makes the appointment, it is a formal function constrained by the political realities of the Assembly majority.

Principle of Secrecy

Principle of Collective Responsibility

Principle of Individual Accountability

Principle of Legislative Supremacy

Explanation

🌟 Quick Verification
